4.3.B HIPAA/Privacy: Patient Rights - Accounting of Disclosures of PHI Policy


    All patients may request and receive an accounting of trackable disclosures of PHI made by LHCC. The potential areas where accounting of disclosures applies are listed in the NOPP. LHCC will provide such an accounting, in accordance with the HIPAA Privacy Rule, when requested by a patient or a patient’s authorized representative.


    • Once a request for disclosures is received by a patient, a “Request for an Accounting Disclosure of PHI” form shall be obtained from the patient.  These requests are forwarded to the Compliance Department.
    • Unsigned requests will NOT be completed (by the patient).
    • LHCC will provide written accounting no later than 60 days after receipt.
    • For each disclosure, the accounting will include:
      • date the request for disclosure was received;
      • name of person requested disclosure;
      • a brief description of the PHI that was disclosed; and
      • a brief statement of the purpose of the disclosure that reasonably informs the individual of the basis for the disclosure.
    • LHCC may exclude those disclosures that qualify as an exception.
    • LHCC will retain these records for 7 years.
